NYLPI Joins Amicus Brief in Support of Congestion Pricing

NYLPI joined a group of transit and environmental advocates in filing an amicus brief in support of the congestion pricing program. The underlying case is State of New Jersey v. United States Department of Transportation, et al. 2:23-cv-03885), filed in the U.S. District Court for the District of New Jersey. The amicus brief was filed on Dec 15, 2023 by Kramer Levin Naftalis & Frankell LLP and accepted by the Court on Feb 9, 2024.

NYLPI, an active member of the Congestion Pricing Now Coalition, has rallied in favor of the congestion pricing program, the proceeds of which are needed to fund a vast array of MTA accessibility improvements, including closing the dangerous gaps between subway platforms and trains, addressing critical issues with paratransit services, and more.

“Residents of the region deserve to receive, as soon as possible, the environmental, health, transportation, equity and accessibility, environmental justice, and positive economic and financial benefits of establishing a large-scale congestion pricing program. At a time when the imminent dangers and adverse impacts of climate change have become all too apparent, the implementation of such a program is needed now more than ever.

New Jersey’s short-sighted and self-serving attempt to delay or prevent the Project’s implementation threatens not only the economic and environmental interests of the MTA and TBTA, but those of the entire region — including those of New Jersey’s own citizens.”
