NYLPI Amicus Brief Supporting Appeal for DOE to Reimburse Attorney Fees to Families of Children with Disabilities

NYLPI, the Council of Parent Attorneys and Advocates, Advocates for Children of New York, and the New York Legal Assistance Group have filed an amicus brief in support of families appealing for appropriate reimbursement of attorney fees by the New York Department of Education (DOE) for disability justice cases now that are currently being heard in the Second Circuit Court of Appeals. Multiple families of children with disabilities had faced their respective school districts through cases against the New York DOE previously heard in the federal court for the Southern District of New York. We affirm that these families are entitled to appropriate reimbursement under the Individuals with Disabilities Education Act (IDEA). The amicus brief was authored on behalf of these four groups by the first director of NYLPI’s Disability Justice program (at the time named the Disability Justice Center at NYLPI).
