NYLPI Files Amicus Brief on Behalf of PEAK Coalition in Support of DEC’s Denial of Power Plant Permit

NYLPI filed an amicus brief on behalf of PEAK Coalition in support of the New York Department of Environmental Conservation (DEC)’s decision to deny a Title V air permit application for Danskammer Energy’s proposed fracked gas power plant. NYLPI is a steering committee member of PEAK Coalition. In response to the denial, Danskammer challenged the decision in an Article 78 proceeding. In June 2022, it was ruled that the DEC had the authority to deny the permit under the Climate Leadership and Community Protection Act (CLCPA).
